The next iPhone will be out soon, and Samsung’s legal team is going to be nice and ready for it: the company’s told the Korea Times that it’s already working on a national sales ban.
If a Korean court granted Samsung the injunction, it’d be an unprecedented victory in the tedious patent slap fight between the two companies (during which only Apple has landed a few slaps).
Once again, Samsung claims the iPhone 5 will step on its own patents. Will it prevail? Probably not. The company’s been unable to prove its case before judges around the world, and given the likelihood that the 5 will be largely similar to its predecessor, their luck isn’t likely to improve. This sounds more like chest-thumping than legal prowess. [Korea Times via Apple Insider]

Tuesday, September 20, 2011 at 8:46 AMThey’re not talking based on designs, it’s based on wireless patents.

Tuesday, September 20, 2011 at 8:48 AMIt was two separate statements, mate.

Tuesday, September 20, 2011 at 11:00 AMInsane like Apple banning the Galaxy Tab 10.1?

Tuesday, September 20, 2011 at 8:02 AMWell, even if it delays Apple for a short time, I would love to see them ducking and weaving, maybe they’ll think twice about acting like giant dicks again! However, I think Samsung may be taking a bigger bite than they can handle here!
Peter
Tuesday, September 20, 2011 at 8:49 AMThe problem with releasing one phone a year… ;)
one of a kind
Tuesday, September 20, 2011 at 9:26 AMI agree Ecky. I love my apple products and all, but they need to stop being such f-wits sometimes!
wsDK_II
Tuesday, September 20, 2011 at 11:01 AM+ 10^9999999 EckyThump, Apple are getting their own treatment turned against them
Paul
Tuesday, September 20, 2011 at 11:44 AMI hope it all goes to plan, they might think twice about acting like bigshots. They’re getting patents in a broken patent system, things should be re-written. Apple are forfeiting evolution in the technology sector for mobile / hand held devices in a way. Which includes tablets.

Tuesday, September 20, 2011 at 8:15 AMI really hope they win, Apple needs to be knocked down a notch. GO SAMSUNG!

Tuesday, September 20, 2011 at 8:53 AMYou know, this corporate bickering sucks, but glad to see Samsung stepping up to take on Apple in their own litigation game.

Tuesday, September 20, 2011 at 9:10 AMOn a side note, Microsoft is probably the one winning out of all these insane lawsuits.

Tuesday, September 20, 2011 at 9:24 AMwhy? so many people don’t even know this is happening, let alone care about it.
even now, i’ve been following these stories since they began, and none of it would weigh in on my choice of a handset were i looking to purchase now.
BenDTU
Tuesday, September 20, 2011 at 9:33 AMPretty much.
And by my Microsoft comment it seems nobody is after them for WinPhone devices, plus they’re making a mint off various Android manufacturers.

Tuesday, September 20, 2011 at 11:03 AMI love my WP7 Handset, and it has been awarded more design and innovation awards then the iPhones combined!
Face it fanboi, you are peeing in your little pants at the sight of these little guys standing up to the big man apple.
and no, im not a microsoft fanboi, i hate apple
BenDTU
Tuesday, September 20, 2011 at 11:52 AMThanks for clearing that up. I hadn’t realized you hate Apple from every single post you put here or anything.
wsDK_II
Tuesday, September 20, 2011 at 11:53 AMNo problems mate, I would not expect you to understand – you are so used to Apple telling you how to do everything i would expect that you need everyone else to spell things out for you as well.
BenDTU
Tuesday, September 20, 2011 at 11:56 AMYeah, must be why I’m looking into going WP7 next year.
Truth be told not everyone who doesn’t slavishly hate Apple is a narrow-minded fanboy.
James
Wednesday, September 21, 2011 at 10:23 AMExactly Ben. If you admit that you love Apple’s products, you’re automatically labelled a fanboy. If something better comes along in a tablet with an open structure ripe for messing with then I’m all for it BUT right now, nothing is really toppling the ipad for quality and performance in a package. \
I can’t help but love the devices that’ve treated me so well over the last 8 or so years. Never had a problem with them, they’re tough as nails, slicker than snot…… I’m happy with Apple’s gear.
As long as they keep on pushing the envelope and driving innovation I’m cool. (yes yes I know you’re all going to say “Innovate my arse!” but they did singlehandedly bring all this new tech to the forefront of popularity).
If something better comes along, then I’ll jump ship……but there is nothing.
mr_herkt
Tuesday, September 20, 2011 at 10:51 AMHows that? WP7 is clearly selling heaps… NOT.

Tuesday, September 20, 2011 at 11:03 AMIt will overtake Apple in 3 years though :)

Tuesday, September 20, 2011 at 9:14 AMThis Corporate litigation arms race is really annoying, since it eventually mean that every phone released will need to endure a period in legal limbo while every other company ties it up in patent lawsuits.
The only way its gonna stop is if the process is cut off at the source, and sorry Apple fanboys, but that source is Apple.
BenDTU
Tuesday, September 20, 2011 at 9:19 AMI very much doubt that if Apple pulled back from their legal strategy everyone else would also pack up and go home.
Ruen
Tuesday, September 20, 2011 at 9:24 AMVery true, Its too late now to go back really. But its was Apple that popularised the process to try to stop supply on a large scale. However, if Apple was to get hit with an Anti-Trust suit due to this, it would send a stern warning to other companies that if they continue they could face the same.
BenDTU
Tuesday, September 20, 2011 at 9:27 AMI thought Motorola going after Apple was the one that started the whole lawsuit-shebang.
Though looking it up now it looks like Microsoft got in pretty early as well vs. Motorola as well.
Ruen
Tuesday, September 20, 2011 at 9:37 AMUrgh, Lawsuit patent wars makes my head hurt.
Obviously Apple wasn’t the organisation that started the whole trend of sue people who violate patents, that process has been around for years, look at how it has on numerous occasions crippled the Gaming Industry (Sony having to hand over $82 Million to a Patent Troll company comes to mind) but in most cases it looks as those the companies are simply looking to make a quick buck at another companies expense. Apple doesn’t look like its after money (lord knows it doesn’t need to) in most cases I’ve never heard of Apple naming a price to use the technology its patented.
This is my problem with with the current patent wars, by all means allow organisations to profit of the advances they’ve made, just don’t allow them to monopolise them if they are for the mutual benefit of the industry as a whole.
BenDTU
Tuesday, September 20, 2011 at 9:45 AMI wonder how long this sort of stuff has been going on. It’s only recently it’s really been reported anywhere.
If it keeps up then Windows tablets/phones are going to look mighty appealing since Microsoft provides full coverage.
Ruen
Tuesday, September 20, 2011 at 10:22 AMIf you want an example of how long its been going on in regards to gaming based patents, or things of the like, look up the history of Patent Lawsuits in Marshall, Texas.
If you want to sue a large organisation for patent violation, yet everyone in the whole world knows you’re a goddamn patent troll… Do it there, you’ll win 90% of the time.

Tuesday, September 20, 2011 at 11:05 AMyou are just making things up now arnt you?
wsDK_II
Tuesday, September 20, 2011 at 11:04 AMYou are wrong BenDTU, in case you havent noticed, Apple is the one who is suing everyone else.

Tuesday, September 20, 2011 at 10:53 AMPiss off Samsung. I have been losing sleep and holding out for a new iPhone and I dont want to wait any longer than I have to.

I hate Apple’s business strategy as much as the next guy, and hate their patronising attitude towards the general pubic, treating them like mindless idiots. Unfortunately, turns out the general public ARE mindless idiots…who knew?
wsDK_II
Tuesday, September 20, 2011 at 11:56 AMTrue, most of the public are mindless idiots, and they love it!
also, i dont understand the reference to Dom….how is that anything like me?
i would much prefer a reference to Emperor Palpatine :D

Tuesday, September 20, 2011 at 12:22 PMWe the consumers are the big losers here, we already have to wait for products to be released in australia (often) long after their international release dates, and through all this IP rubbish it just makes the devices we pay top dollar to own even older by the time they hit the shelf. I for one was waiting to purchase the Samsung 10.1 tab when it was released but now it’ll be at least 6 months old when/if it does get released which is an eternity at this end of the market.
So i bought a new laptop instead and vowed never to buy another Apple product again
Daryl
Tuesday, September 20, 2011 at 8:47 PMDamn Apple for blocking the 10.1, guess I’ll have to get the Xoom, which has been available since Feb.
So nobody benefits except lawyers.
I agree with Nate, takes too long and costs too much by the time products sell in Australia

Tuesday, September 20, 2011 at 9:08 PMIt’s from Apple Insider… they’re a pretty unreliable and biased news source.

Wednesday, September 21, 2011 at 9:10 AMAs ye sow! Payback is a bitch Apple. Seriously, this litigation madness by Apple et al is becoming ridiculous. What ever happened to good old market competition? If you create a good product people will buy it. Apple should have put more effort into the iPad 2, iPhone 4, etc, than relying on law suits to stifle competition. I’ve said before that this seems like an AppleSoft conspiracy to stall competition until Win 7 phone is available. I’m writing this on an iPad 1. Version 2 isn’t significantly better to entice me, but the Samsung Tab would be if I could sample one.
