Samsung has won a patent battle against Apple that could see the iPhone 4 and 3G iPad 2 banned from sale in the US. The legal fight was centred on a patent relating to 3G standards, which Samsung has pledged to licence freely, reports The Guardian.
But according to the International Trade Commission, the patent was infringed by the iPhone 4 and 3G iPad 2.
While Apple claimed that Samsung failed to licence the patent on “fair, reasonable and non-discriminatory” (FRAND) terms, the ITC was having none of it. Apple will now appeal the verdict — it’s claiming that it will have “no impact” on sales — but in reality the iPhone 4 and 3G iPad 2 could be banned from sale in the US.
