Judge Cuts $450 Million Off The $1 Billion Samsung Owes Apple

Judge Lucy Koh has given Samsung a huge discount on the damages it owes Apple. Originally billed to pay Apple over $US1 billion, Judge Koh has cut $US450,514,650 from Samsung's tab. The new total that Samsung owes is $US598,908,892. Still an unfathomable amount of money but an unfathomable amount of money less now.

The reason for the discount is that Koh found that the jury had made an error on the timeframe of when the damages were made. Meaning, according to FOSS Patents, "The jury based its award on the notice date provided by Apple, which Judge Koh now believes was too early because only one of the patents, the rubber-banding patent, had actually been listed in a presentation Apple gave to Samsung in 2010."     That's good to hear. 1 billion was way too steep. Apple is just afraid that Samsung is beating them.


    In the only significant legal case Apple has won, over small design details, apple has similarly lost half the payout, over small timing details.

    And the case will head to a second damages trial, which may or may not come to the same conclusions as the first.

    Given some of the interim reported comments by Judge Lucy Koh, and the previous jury's lack of clarity on the damages, it could well be that apple continues down a losing legal path, however this is just wishful rather than legal speculation on my part.

    This judge isn't lining up for a job at Samsung too is he. Didn't some other "judge" cane Apple then go and work for Samsung?
    I gotta wonder who the real crims are here.
