UK Judge Rules Galaxy Tab 'Not As Cool' As iPad

Samsung mustn't know whether to celebrate or not; a UK judge has ruled that the Galaxy Tab doesn't infringe Apple's registered design in large part because it's "not as cool" as the iPad. Ouch.

Speaking in court this morning, Bloomberg reports, Judge Colin Birss explained that the Galaxy tablets "do not have the same understated and extreme simplicity which is possessed by the Apple design... They are not as cool."

As a result, Biriss has judged that consumers are unlikely to confuse the two tablets, meaning that Samsung's product doesn't infringe Apple's registered design. Intriguingly, he explained that the Galaxy Tab had "unusual details" on the back that set it apart from the iPad.

Apple has 21 days to appeal against the ruling, and going by its track record, it probably will. Meanwhile, Samsung is no doubt trying to work out whether to be happy or not. [Bloomberg]

    By the same token, extreme simplicity could like an iPad to a children's toy... which is pretty much what they are

    That's the stupidest thing I've heard to date on this topic. We're judging a products worth by whether or not the are cool compared to another product now...!! I'm a devout Apple atheist, but this is not a proper way to compare it. This judge should be sacked for incompetence!

      He's not comparing the relative worth of the respective tablets at all... At no point did the judge say "the iPad is cooler, therefore it is the better tablet." The point of his statement was to differentiate the tablets on pure aesthetics alone.

        How the hell do you differentiate between similar devices in legal terms by saying that one is cooler than the other. The argument is specious and quite ridiculous. Here's something the judge should have ruled...'Apple, stop suing the crap out of anyone that might be genuine competition" !!

          I agree it's probably a bad choice of words, but the ruling wasn't "the Galaxy tabs aren't cool, therefore they don't infringe Apple patents"...
          The ruling was that the Galaxy tabs "do not have the same understated and extreme simplicity which is possessed by the Apple design,” to which the judge unnecessarily added that this was due to them being "not as cool." Again, probably not a smart move, but NOT the crux of the ruling either...

    Lol.......if Apple appeal the ruling, it would be like them verifying that the Galaxy tab is just as cool (if not cooler) than the iPad. Lose-lose situation?

      Maybe the judge was smarter than we thought, how can we get Apple to stop these darn lawsuits. I know tell them what they want to hear, that they are the coolest. Now they wont want to fight that judgement.

    Yes, because UK judges are well known specialists on the subject of "cool", celebrated in song, TV shows, plays, and even movies for their well known mastery of this subject... Yes indeedy, the image of a fusty old bewigged and gowned British judge squinting over a pair of granny glasses is the iconic image of the arbiter of "cool".
    What's next, will we take the prime minister's advice on what the latest greatest bans are? Maybe parliament should be consulted on the upcoming fashions and hairstyles?

    Now everyone will buy Samsungs to buck the trend of being cool!

    The judge sat in a hipster cafe sipping a latte,using his Galaxy with a smarmy look on his face. No one paid him any attention. He declared himself and the tab uncool and unworthy. Judgement scientifically made.

    Perfect statement from the judge, sarcasm at its best. As if Apple needed to sue someone to rule the world. They need Android and Samsung to steal ideas and make dumb-proof.
