Apple and Samsung headed to court this morning, and as per the Sydney Morning Herald, it looks as though Apple’s still in the driving seat of this particular legal stratagem, having forced Samsung to delay the launch until at least September 30th.
Samsung was apparently seeking to launch the Galaxy Tab 10.1 in the week starting September 12, and had provided Apple with three samples of the Australian version of the Tablet, but Apple’s claim was that they still infringed on tablet patents held by the company. It also appears that, just as in the European case still ongoing, Samsung’s going to argue against the validity of Apple’s patents on the grounds of them not being particularly novel. I wonder if that means they’ll use 2001 as evidence of prior art again?
