AFACT Taking iiNet To The High Court

Considering how much of their rhetoric is complete and utter BS, it isn’t really surprising that AFACT has taken their second straight loss to iiNet poorly. The Australian is reporting that the anti-piracy lobby group has applied to take its case to the High Court in the hope of proving that iiNet is somehow responsible for its customers’ piracy.

Should it be successful, the application is expected to go to a special hearing in the Sydney High Court in August or September this year, with a verdict arriving early next year. Given that the High Court is the highest AFACT can possibly take this, let’s hope the judges make a quick and unanimous decision to end this stupidity once and for all.

      I agree with you there, but we should go even further, all weapons manufacturers should be responsibe for what is done with their equipment.
      Even the companies who make knives and why not the camera companies because it’s there prodcuts that take pictures for child porn or the monitors they are viewed on?

    1) It is illegal for ISPs to monitor the content of their customers traffic without a court order.

    2) It is also illegal for ISPs to provide personal information about it’s customers without a court order.

    This is the way it is. My freedoms are exactly that. If I break the law, someone can provide proof, get a warrant, and take me to court. Our laws already provide for what AFACT want, they just want to make it easier for themselves.

    To create provision in the law to monitor traffic without a warrant takes us into very murky personal rights territory…like America. It’s unAustralian to be ‘like America’, but seemingly this is what AFACT want for us.

    Other fun things that come from tinkering with personal rights: TSA inspections, detention without charge, rights of search without warrant…

    Nah, lets hope the judges allow it, and then immediately tell AFACT to pay all costs associated with all the wasted court time across all courts as well as all the costs of iiNet incurred in mounting their defence, before moving on to a case that actually deserves to be heard.

    Who is paying AFACT’s bills? I’m guessing their money is coming from Hollywood. Therefore the film studios are set to lose plenty with this endless stream of stupidity. If only they would channel their efforts into a decent LEGAL distribution network, they would put a big dent into piracy and make money into the bargain. It doesn’t take an economics degree to figure this out.

      No, they are only losing money to Piracy. It has nothing to do with massive legal bills on pointless endeavours and paychecks for actors in the order of 10s of millions of dollars!

    This has given me a great idea. My ex-girlfriend used a telephone to spread lies about me to her friends, which is defamation, so I’m going to sue TELSTRA!!!
