Sarah Palin Email Hacker Faces 5 Year Prison Term

If prosecutors have their way, David Kernell, the 20 year old son of a Tennessee state representative and prime suspect in the Sarah Palin email hack will make an inmate looking for a young, supple jailhouse bride very happy. He was indicted today by a federal grand jury in Knoxville, Tenn for illegally accessing the account and faces up to 5 years in prison, a $US250,000 fine and a three-year term of supervised release. A trial date has not been set, but it is safe to say that things don't look good. [USDOJ via Crunchgear]

Dan Burton, II - Son of Rep. Dan Burton (R-IN)
Burton was busted in January of 1994 on charges of possession of marijuana with intent to distribute. Allegedly, Burton II was transporting seven pounds of marijuana in a car from Texas to Indiana when he was caught in Louisiana. Burton II plead guilty to felony charges of possession of marijuana with intent to distribute. Rather than face ten to sixteen months in federal prison, Burton was sentenced to five years probation, 2000 hours of community service, three years of house arrest and random drug screening. Five month later police found 30 marijuana plants and a shotgun in Burton's apartment in Indianapolis. Under federal mandatory minimum rules, Burton should have received at least five years in federal prison, plus a year or more for arrest while on probation. State prosecutors decided that the total weight of marijuana from the 30 plants was 25 grams (about one ounce), thus reducing the charge to a misdemeanor. The Indiana prosecutor threw out all the charges against him saying, "I didn't see any sense in putting him on probation a second time."

If it was an average persons email account that was being "hacked" into, i really doubt there would be any real criminal charges, maybe a fine, unless there is a law that says government officials personal property is more important then the average citizen

This is sorta crap. I'm guessing that the weight of his punishment is meant to act as a deterrent for future potential crackers, not as a suitable form of justice. I would like to know the last time someone got that much time for such a crime (against someone who was not political like Sarah Palin).

Yeah, what he did was technically illegal, but am I the only one who can sympathize with him? He's not some computer guru, he just googled for the answer to Palin's security question and was sort of shocked when it worked. He didn't know what to do so he posted it on 4chan. Other people (who knew how to use proxies) went a grabbed the documents and one person changed the password to something else and informed Palin's office.
Personally I'm a little more worried about Palin's incompetence in securing her Yahoo account and her usage of it for official government business in order to avoid Freedom of Information act requests (which happens to be illegal).
He didn't hack or crack anything- it's the equivalent of opening a mailbox and grabbing a piece of mail. I'm not arguing that it isn't illegal, but 5 years in jail (or any jail time at all) hardly seems to be justice.

You think you guys have it bad, here in the Philippines they just recently granted executive clemency to a convicted murderer and drug user after doing just 14 years in prison. He was supposed to serve a life sentence.

This guy is NOT a hacker. This guy did the equivalent of tricking the security guard at the door by knowing the secret phrase, rather than kicking down some side door and entering. Paris Hilton had her secret password also guessed for access to her T-Mobile account. Stupid people - they need to pick stronger/harder to guess secret words/answers.

A show prosecution and a joke. It was an unofficial address and the security essentially didn't exist, and it belonged to a highly prominent rising figure the world is asking questions about. Substantively no different from hijacking someone's myspace page or sending texts from someone else's phone. Kids life will be ruined as a political manoeuvre.

Invasion of privacy is okay, as long as it's not a government agency doing it, and the victim is unpopular and/or a government official? That's ridiculous. The kid should get what's coming to him. That's how our justice system should work. Granted, this may have happened before with less punishment, but it probably didn't happen to such a highly visible target, and most perpetrators aren't so stupid as to incriminate themselves with so much damned evidence posted around in public view.

That's a pretty long sentence just for plugging in the answer to a security question; especially when Palin herself announced the answer to her security question on live television for millions of viewers to hear. Doh!

The empath in me thinks this poor kid is surely scared shitless, I don't know how old he is but I'm sure if I were he I'd want to just delete myself.
Another part of me though sees that he did pick a bad person to hack. Sort of like duh, you shouldn't try to hack the FBI. Thats how I sort of compare it in my mind.
But then, back to my emotional side, I sort of feel that this terrifying experience would be enough of a punishment for the kid.

@Griffehpoo: I wouldn't really consider it invasion of privacy since, again, the Yahoo account was being used to illegally circumvent the Freedom of Information Act. If Palin hadn't used the Yahoo account then all of that information would have been publicly available. When you work for the government, your email is the government's email- they tell you that upfront, and it applies to all government employees, from the President (though good luck getting any information from this administration, I'm sure it's all classified or redacted or something) to your local librarian.
The law isn't always just, and there's such a thing as civil disobedience, which in my opinion is what this should fall under. Yes, it's still technically illegal, but so is breaking an encryption, even if it's professors at a university proving that a particular encryption method is flawed.
He'll either be prosecuted under the law, or justice will be served, but as things stand the two are mutually exclusive.

That, at the minimum, locks out the original user, even if only briefly - once they go through the challenge requests for confirming who they are.
It's still a felony and he only did it because he hates her - not because he wanted to do good by her. He'll get what he deserves.

I think it is pretty ridiculous we give prison time to non-violent people. Honestly...prison was created to seperate society from rapists, murderers and the like. Not as a punishment for sending spam emails, defaulting on your taxes or hacking an email account.

Please, he deserves far worse than what little punishment he'll get. Let's see how any of self righteous people would feel if something similar happened to you or another family member. When someone tries to screw another person in a bad way, it shouldn't matter if there is a D or an R after their name. That's so freaking stupid and pisses me off. So what if she is a possible VP. If he had done this to anyone else he would not be facing this charge. I think he did something good. he showed an extreme vulnerable point, what if someone with bad intent had run across these government e-mails after hacking in? If anyone should be facing charges it's Palin.
