Amazon Retires US$38.45 52-Inch Aquos, Puts Orders on Hold
Posted by Jesus Diaz at 10:22 PM on September 7, 2008
Error or scam, Amazon has pulled the page with the 52-inch US$38.45 Sharp Aquos, probably overwhelmed by the orders from crazy Giz readers dreaming about a glorious, gigantic HDTV in their living rooms and/or toilets. Reader Max called Amazon to check on his order and they told him there was something weird going on:
Just called Amazon and talked to a lady who seemed confused, as on her end the product was listed at well over US$1,000. That's still a major price anomaly, though. She said she would try to contact myOfficeSource. It is now listed as "Currently Unavailable", no less than 5 minutes after I made the call. It's most likely been pulled as a precautionary measure.

Interesting Bit of news....
Since the 52" deal was bust already when I saw the page last night I figured I would take a chance at the 46" Aquos through myOfficeSource for 38.45. As of today my order still shows a go, but the interesting thing is if I click on the item I ordered it is no longer sold by myOfficeSource. The item is now being sold by 6ave. Here is a link to the item now: [www.amazon.com]
Seems myOfficeSource has no more TV's available.

I think they should at least honor one order/account. This way they will lose a lot of money, but likely will not get the bad feedback they get if they cancel every single order.

They never would have shipped them. Until your CC is billed they can cancel it, and they would have / will.
On Black Friday last year I ordered a MX Revolution from Amazon because it was something like $30 with an additional $20 MIR, so screaming deal but nothing like a 52" 1080p for $40. I buy it, get the confirmation email, etc. Later in the day I noticed that the price had changed to $50 with a $20 MIR. I figured I got lucky and got early bird special or something... nope, sat in limbo for a few days, then I got an email from Amazon saying that it was a mistake and the order was canceled.
So all of you who placed orders, expect to be getting an "order canceled" type email.

To be honest, I hope they ship them all. It would be a reversal of the classic "bait and switch" tactics that businesses have tried pulling for years.
You know what I'm talking about... the ad for the car you have been wanting for ages that shows $2,000, but in small print it was only stock # 0010103, which they sold to the dealer's brother the night before?

I have good news maybe, after I placed my order for the 52" Sharp last night I called Amazon to double check on the order. Wanted to see if it seemed kosher to them. The customer service rep I spoke with confirmed the order and all information related to it. Stating that "everything was okay, and that it would ship Monday." This morning I checked my account and the amount of $145 (shipping included) had been withdrawn. So now I'm hoping that they've taken my cash they will be forced to send the product. I have complete documentation of the conversation and everything, so lets hope.

Amazons policy states that in the event of pricing error they will contact and refund.
So everyone keep hoping, but its not like this is the first eCommerce site that just launched yesterday.
Oh, and all the people that keep yelling "legally binding contract!", some stores have T's & C's where they state that the contract is not complete until the goods ship.
Everyone do the math... do you really think they are going to spend $1000 per TV (let's assume their cost is that low but it is really $1500 on $2000 TV) on 1000 TVs sold and lose $1M. No chance.

What a stunning testament of the total lack of ethics of so many people here. People are upset at someone who made a phone call that might tip off Amazon or myOfficeSource that could avert the loss of hundreds of thousands of dollars. If they didn't figure it out and ended up shipping everyone's TV at $38, this company would have gone bankrupt, everyone would have lost their jobs, and some of the unemployed might have subsequently defaulted on loans and mortgages; leading to homeless and starving families.
But you're alright with that as long as you get a TV for $38. This was clearly a mistake and some of you are even prepared to take them to court or at least give bad feedback for correcting the error before disaster struck.
WOW!

@Radau: Seriously. Get real Phredd, if you list something incorrectly and somebody buys it, you gotta eat the cost. Sure you don't want to lose money on a stupid mistake, but your business tanking would be a far worse result. In this day and age the internet could ruin your business in a hurry if you don't honor pricing mistakes like that.
Case in point; I just scored a great deal through Cragislist. Although not a big business that could be ruined, the guy still honored the mistake. He could have easily deleted the ad and told anyone who called to F off and that he wasn't selling for that price, but the man stuck to his word. He was selling a Bowflex home gym with accessories that totaled $3800 in value. All the equipment is a couple months old and only used a few times. His wife mistakenly posted the ad on Craigslist for $900, and within 3 hours he had a dozen calls; everyone wanting to come out the next day to check it out. Luckily I went out that day and came home with a practically brand new entire home gym setup at 1/4 the retail price.

@G-Ram: Not my experience, unless the pricing was intentionally misleading or the company was very interested in retaining me as a customer.
For evidence, go enter any of the big e-commerce sites (Amazon, Expedia, Buy.com, etc.) into Google along with "pricing mistake," read the messages of complaints, and see what I mean.
Besides the fact that Amazon has specific language in their t&c to address pricing mistakes.

My bet is if they do honer the price that My Office Space will be the new Best Buy with the popularity they would receive, I would order more from them if it's true.

@Assassin_Kensei:
My bed is that if they did honor the price that their stock price would fall and/or that they would be close to being bankrupt.

@ttech10: my bet is that they do not trade publicly, having zero stock; IF they did, their investors would be: a) shitting bricks (and/or) b) looking for the nearest skyscrapers

Well as of now, still, my order is still set to ship out later today (Monday) or tomorrow... though I doubt it will.
Should be interesting seeing what the next Amazon/52"/MyOfficeSource post on Gizmodo is about.

I just read through all of Amazon's A-Z coverage and it looks like they are required to send the T.V.s
though If I were them I would send the TVs order new ones on credit and then file Bankruptcy, then sell the TVs marked down just enough to recover the price of the original stock. Not sure if that is Legal though.

said it before (nobody listened), so i'll say it again: read the terms and conditions. yeah, you just dumbly thought that you score a tie-breaking point? (didn't read it). advantage customer? (didn't read it). pricing mistake? (didn't read it). some sort of lawsuit against Amazon.com? (didn't read it). because your credit card was charged you think that constitutes a contract? (didn't read it).
& ur speling is atrochius.

since it's a third party.. amazon does not have any claims in this lol. they're merely a translator just directing the two parties. all policies are governed by the third party dealer.
where are you reading your policies from? lol

I do feel quite badly about what i've done now.. we've ceased an operation day for them :/
Like i mentioned before.. this can all be remedied if they can send me a FALLOUT 3 for the PC (collectors edition with pipboy) right now. they're the same price = $100 dollars :)

yeah, to everyone who is being negative about this, there is nothing bad that can come out of this. you're just jealous because you didn't have the guts or the money to do it. only two things can happen:
1. amazon cancels the orders and returns your money
2. error happens and fixed, people get tvs, someone at amazon gets fired.
muahaha lets just keep our fingers crossed :)
i bought three 46inch aquos

i doubt myofficesource will be selling on amazon anymore (unless it was an error by amazon), which will lead to myofficesource failing as a company. Their site was crappy and shady so im sure they relied on amazon for most of their transactions.

OK, I understand canceling my order. I will be diligent about making sure that my credit card was not charged by Amazon.
To remove the order *completely* with no way to provide feedback? This is just going to be swept under the giant corporate rug.

@LesterGaze: Well I agree with you there. Not honoring a pricing mistake is going to garner complaints, bigger corporations won't be very affected, but a small privately owned business could easily be ruined. We've all heard about "word of mouth" and "if you do a good job, a customer may recommend you a few friends. But if you do a bad job, they'll tell everyone they know not to give you any business." This is easily extrapolated with the internet these days, and a small business could suffer greatly due to one small screw-up.

I ordered the 46" Sharp and the 32" Panasonic, and I just received the same cancellation email from Amazon. I spoke with an Amazon customer service rep and asked them under what policy the order was cancelled. Initially, the rep directed me to Amazon's Pricing policy (Help > Payment, Pricing & Promotions > Pricing), but that policy clearly doesn't apply here ("Please note that this policy applies only to products sold and shipped by Amazon.com. Your purchases from third-party sellers using Amazon.com Payments are charged at the time you place your order, and third-party sellers may follow different policies in the event of a mispriced item."). When I pointed this out to him, and asked about Amazon's A-to-z Guarantee Protection (Help > Privacy, Security & Accessibility > A-to-z Guarantee Protection), which might, in theory, guarantee this transaction, he countered that Amazon (and/or MyOfficeSource) had not charged me for the sale. And he might be right: "When is a buyer covered under the Amazon.com A-to-z Guarantee? ... [When] [t]he buyer made payment to the seller through the Amazon.com website ... but the seller failed to deliver the item." Currently, the charge on my credit card is only "Pending." I'm assuming that means that the merchant checked whether I had enough credit for the purchase, but hasn't actually charged it yet. I'll be watching closely to see if the Pending charge becomes official, even if only for a minute or two before Amazon refunds it. If your credit card really, truly was charged (not just "Pending"), then I think you have a good argument that Amazon has to cover you under their A-to-Z policy.

@Phredd: If Nature was as tolerant as you our species would have never appeared as having brains would have never given us any advantage. And markets works just like nature - some times a disaster promotes new growth (such as a software engineer developing a posting system that checks for items that are 98% off)
I placed an order, I'm curious to see what happens next.
The way I see it selling 10-20 TVs at $1000 loss per item in order to generate internet buzz is MUCH cheaper than trying to get the same amount of buzz via conventional advertising. As such the 'mistaken' prices can very well be advertising trick, which would make us eligible to get the goods or possibly make legal claims to it.

from the ftc.gove site:
"While satisfied customers generally mean repeat business, price errors that stem from haphazard or inefficient pricing practices can cost stores money. For one thing, the dollar amount of undercharges often exceeds the dollar amount of the overcharges. For another, it is against the law to charge more than the advertised shelf price. Stores that do may be subject to civil and criminal fines."

I once was in the market for an LCD monitor. I found this website that was selling one for 23 bucks (20")and I immediately proceeded with purchase.
Next thing I know, I received an email the following day apologizing for the typo, and that my order was cancelled, but they invited me to re-purchase the thing at regular price... boooh :-I
