52-Inch Sharp Aquos HDTV for US$38.45 (Or Not Really)

Right now, one of the stores at Amazon.com--myOfficeSource--is selling a 52-inch Sharp Aquos 1080P HDTV for US$38.45 (thirty-eight dollars and forty-five cents). That's US$2,261.54 off its list price. New, not refurbished. Obviously, something wrong--or fishy--must be happening because, right now, you can buy a bunch of products with this discount. Giz reader Cliff, who gave us the heads up, actually bought the 52-inch Aquos and got a confirmation email from Amazon in which they say his order will arrive in mid-september. Update: One reader is giving a word of caution, so proceed with caution because this may be an scam.

They charged him exactly what the catalog says. Nevertheless, this must be a bug but, in any case and since they are not charging the original price, I guess it's worth trying.

The question is: if a mail order company is advertising and actually confirming the purchase at these prices, are they obligated to honour the advertised price and send the product? Somewhere in my mind, a couple of advertising law clauses I took while in college are saying "yes, they may have to do exactly that". But then again, I may have had a hangover back then and got the whole thing wrong.
Update: a reader has sent us a heads up about a customer review in Amazon.com that says that someone who bought the Texas Instruments calculator got his order switched in his account page for a CD. Cliff says that his Amazon account still lists the Sharp in his order. If this is the case, I don't really know how Amazon can keep such an allegedly shady store in their site. In any case, proceed with caution if you really want to try your luck.

Ok boys and girls, here's the d.l. from a law student.
1) The company CANNOT change the price on you. They cannot say "t.v. for $100," you buy it, then they change it to $1000. CANNOT DO IT, STOP WORRYING ABOUT IT.
2) NY state law states that once something has been bought (in this case, your account has been charged, as in my case)for a set price aka $100 t.v., the BEST a company can do is OFFER a refund. YOU CAN REJECT IT, and they have to give the item to you, at their loose. However, this more than likely does NOT apply to out of states, sorry folks not in NY.
I'm just hoping this sh*t is all automated, and they send it out, easiest possibility. Someone f*cked this up hard, either myofficesource, or amazon. Again, if Amazon did, they would have to pay myofficesource the remainder of the price. Myofficesource would only HAVE to ship the items, if it's their mistakes to NY residents, as long as the customer rejected the refund, which I would do before they even said it.

I too am a law student. Duo, you should probably read your contracts book again...it's a whole new ball game with online companies not to mention we have to deal with an Agency/Principle relation with Amazon and MyOfficeSource. Who takes the hit when things go sour? Amazon or MyOfficeSource? Do we, as users of Amazon, have a separate TOA saying that Amazon has the right to cancel any order for any reason? I'm sure as hell not reading that full service agreement.

If you know that the listed price is seriously in error and you take advantage of it, they do not have to honor it. Since the price is so off-kilter for the market and there is notice in the reviews, you are on notice about the problem. Thus, they have no duty to sell it to you.

If all of us are purchasing one... as I did... where the hell are they going to get all of these TV's??? Thousands of people are purchasing them right now. Even if this is something that can be held up in court the only thing they will be liable for is refunding our money. There is no way all of these people will get a TV... additionally, there is no way we will get any money from a lawsuit either. Best we can do is hope something goes terribly RIGHT in our favor!

I figure,if it is a problem,I ordered it with my platinum Visa,which has been excellent in resolving issues I have had with any type of charge in the past,so best case, I get a TV for cheap,worst case I make a few phone calls and it goes away.

Can afford to wait for the refund if they don't honor it.. CA NOT AFFORD to be left out of they decide to honor some of the sales. They could even pull a Lenovo here. Remember when lenovo misprinted the price of the 128GB SSD drives!! great example of how it SHOULD work, they didnt give everyone free 128GB drives, but they did give them all upgrades from what it should have been. i think they got 64GB drives instead of 32GB. I would gladly take a 20inch in place of my 32 for 100 bucks lol.

I've given it a shot.
When you search the item and it comes up as the lowest price it says "low item price" underneath the price. Its the only one with this odd description. Maybe it means something. Could this be a clearance thing and not a mistake?

From having family work there I know it's a pretty intensive thing to set up an item, so I'm only assuming that Amazon is the one at fault.

Grocery stores always honor lower prices when they make a mistake. This situation should be no different IMO. We all purchased an item at a listed price, we deserve the items for said price.

@mobiuslogic: Yeah that makes a lot of sense. I've seen this same thing happen before on Amazon. It usually gets caught by the company shortly after the mistake is posted, but sometimes the first couple dozen get through thanks to automation. I ordered one anyways, though, hah.

I'm in for one, as of 8:18 Arizona time (Pacific time, basically) it was still in there for $38.45, with $105.24 shipping (which I'd expect on a TV shipped from anywhere but Woot.com...). What's the worst that can happen? They cancel my order and I get my money back. Best that can happen? I swap out the 42" Olevia 720p that I have in the family room with this and move that one into the kids playroom, getting rid of the 37" Olevia in there.

They probably put the NEW sale price in the DISCOUNT section instead. Therefore a $149.99 calc should have been a 4% savings to $143.25. However, the discount field was filled in with the new price, giving a 96% discount.

The 52" TV is now sold out, but there's a 46" version available for the same purchase price...but the S&H is slightly higher. Oddly enough, there's also a 26" and 20" Aquos model selling for the same purchase price, but again the smaller model has slightly higher S&H. Weird.

The description says that they have 57 warehouses that they ship from.
Deal was posted on slickdeals.net at 5:15 pm today. Amazon said that they'll ship out on the 8th or 9th... pray that no one notices this until it's too late!

I ordered several of the 32", 46", 52" as well as a ton of other obviously incorrectly priced items from this store. Several good video cameras and digital cameras too. Just search the whole store. I got the orders in a little after 10PM EDT.
I don't expect MyOfficeSource to honor these prices, but I sure as hell am going to hold Amazon accountable for the prices. This is definitely a mistake and I am dying to know how this all will wind up. I don't even need any TVs, but this was too good to pass up :)

I too purchased a 52" TV on the slim chance that it actually happens. BUT in looking at the Seller's Policy section.. The Seller has the right to cancel an order at any time before shipping:

Shit, I signed up and got to place my order but got scared, it also said 1 left, but I don't want to tie up my money in the event it doesn't fly, I hope I made the right decision to NOT hit submit, whew.....scared of not doing it, and scared TO do it. I ordered a PS3 two weeks ago, on Amazon, but through an individual seller like these folks selling these TVs, and that guy turned out to be a fraud. [www.amazon.com] Amazon tells me not to worry though; All I've got to do is wait until the end of the expected delivery window, and they'll refund my money for me after filing a claim. A process which they assure me it isn't terribly complicated.
Fingers crossed to say the least.

Interestingly enough, there's both a myofficesource.net, AND a myofficesource.com. Their seller profile on Amazon.com refers to myofficesource.net, but reflects the same contact number as myofficesource.com. When searching the '.com' site, only Panasonic and Sony TV's come up, and the '.net' site has a bunch of unlabeled TV's that are out of stock. Also, there's something that just doesn't look right about myofficesource.net.
In any case, those are just my observations. I too purchased a Sharp 46" LCD for $146.09, so I'm in the same boat as many others here. We'll see what happens!

The price that's shown depends on how you link to it. You must use the original link or it shows reg. price.
When all of this is over, I hope everyone doesn't go and slam down these folks' ratings for a pricing error. That would be uncool. Everyone has a shitty day sometimes.

if i know my retail law correctly, they only have to honor the price if the product has an actual label on it stating that price...if its on the website or on the shelf, they are not obligated to it...and im sure if you look in the EULA for amazon...you will see they are not responsible for misprints.
