Psystar HQ Up for Sale, Buy It Now for US$4.6 Million
Posted by Matt Buchanan at 5:20 AM on July 20, 2008
Not looking so good on the Psystar front. Following Apple's inevitable lawsuit and demand that every Mac clone be recalled, apparently their HQ is on the market and "priced for quick sale" by owners Constructora Canahuati. "Find new headquarters" is a hell of an addition to an already busy to-do list. [Yahoo!, Thanks Sean!]

buying the company would put the buyer in the firing line, no?

OMG! Ponies!

And this is why, when we want to do things of dubious legality, we don't incorporate in the United States and instead go for places like the Cayman Islands.

The people who own the building are selling the building. This is unrelated to Psystar, which is almost certainly worth less than zero.

@92BuickLeSabre: LOL
I don't think they had a huge customer base anyways. :/

Are they selling the real store? Or just a clone of it?

@justinsane: Yeah this is really just a funny coincidence/ bad luck, for psystar.
Giz should really stop the rumors: Pystar doesn't own the building, they are not selling it to raise money for the litigation. Honestly, does it even make sense that Psystar would have the money to purchase a $4.6million building to begin with?

@urbanturban666: Actually, it's a rather unique form-factor and great value
Now much copied in the PC world, but never matched.

I'm unsurprised by this news. These guys had to know this was going to happen. And they did it anyway-- and apparently had no real business plan. I'm not happy they've failed, but I'm glad Apple protected their IP. Intellectual property is protected for a reason.

Wait, are you saying that somebody saw a quick, easy way to possibly make a crapload of money, even though it was blatantly illegal & unscrupulous? Somebody call 60 minutes, quick!!!

It's amazing they didn't build a factory in China to do this and get a patent there for whatever they were doing. It's so bad there that I heard of one inventor who patented an item here in the U.S. and someone in China copied the documents and much later filed for a patent there, then sued HIM from China for patent infringement so he couldn't sell the item in China anymore.
They must not have consulted with any kind of lawyer before going down this road, unreal how you could kid yourself into thinking that Apple wouldn't/couldn't do anything about it.
Of course Apple isn't innocent either. Remember back when they settled with Apple Records that they could keep using the name, but only if they kept out of the music business? I think we all know what happened there.

@MINI Driver: its value is questionable.... i mean the new imacs whole eliminating a seperate tower thing has made the minis format even less desireable... what they gotta do is cook up a netbook!!!

Does anyone else find it slightly ironic that Apple is suing them for "Unfair competition" (among other things) when they have positioned themselves as Apples *only* competitor? I'm not a lawyer, of course, but I really fail to see how Apple has a strong case here -- if they're on the right side of the law, the law should be changed.
After all, Pystar, whatever its flaws may be, isn't pirating anything -- they're merely breaking a EULA which, as far as I Know, has never been proven to have the same legal strength of an actual contract.
But, of course, IANAL -- just a guy who knows the difference between right and wrong which is often not the same thing as the law.

now if only they went with getting an aggreement with Ubuntu Linux with the theme Mac4lin for its operating system it would have been a different story.

@Faxmonkey: What I'm curious about is the OS X copy loaded on to each machine. I have a hard time believing that Psystar didn't just take the same copy of OS X and just load it again and again on their hardware. Since OS X doesn't have the DRM restrictions limiting the amount of machines you can put it on, this can be done pretty easily.

Psystar will not have to refund people for their Open Computers. Customers would have to return OSX software and have Psystar replace OSX on hdd with Linux or Windows. If customer chooses Windows, Psystar doesn't loose money.
However, I hope something good comes out of this lawsuit. Apple is obviously practicing monopolistic behavior here.
