Fark Attempts to Trademark NSFW, Gizmodo is Like 'WTF? TFSU!'

Drew Curtis and his company Fark, in their quest to rulzor teh internetz, filed an application with the U.S. Patent and Trademark office to lay claim to the acronym NSFW. Seeing as we like to use the acronym to prevent employed and/or righetous gadget freaks from becoming enraged, we take an interest in the all-encompassing control they want over the term.According to the app, the trademark rights would cover all of the following:
Entertainment Services namely providing a web site featuring photographic, audio, video and prose presentations featuring comedic captions regarding current events and online discussions and/or reviews of web materials of an adult nature; Entertainment services, namely, providing a web site featuring musical performances, musical videos, related film clips, photographs, and other multimedia materials; Entertainment services, namely, providing on-line reviews of photographs and /or web postings of an adult nature.
So let me get this straight – Fark wants to take a vague, general acronym they didn't create and receive the online rights to it? Hmmmm...good luck with that. I think I'll go and trademark LOL and BRB now. [Fark Trademark Application via Ars Technica]

Were I part of Gawker Media's legal department, I'd trademark the word "douchebag" and all derivations and then send a C&D letter to Fark and its subsidiaries.

This is kind of sad. I used to be a huge Farker, even ponied up the $5/month for about two years. I had always felt that they were "counter culture", and good at what they do. Unfortunately, the culture in TotalFark changed and I started to drift away to other sites.
I went back a month or two ago and just found a lot of crass. Maybe my nostalgia goggles were on tight, but I don't remember that much when I was there. (There was a lot of snark, but it seemed to be in general good fun.)
The fact that they took a move like that, which to me seems like a douchebag (ha) move, just makes me all the more reluctant to ever go back to Fark. In all likelyhood, any stories submitted about it there are probably ignored/deleted, and anyone raising a ruckus banned. They like to keep a tight ship, but sometimes too tight.

since apple has white, black and the colors of a normal rainbow... i wanna patent all other colors (including those you cannot see) except magenta (t-mobile beat me to it). oh yes, and lowcase letters (somebody else patented the entire alphabet on caps, that is why the capslock does not work on apple machines).
the term word is patented by microsoft so we won't be using that either. and remember that you are not allowed to see outside unless they give you a proper license for your windows (one for every hole on a wall with some translucent material).

Look, people. This is a Trademark application. It's not a patent; it's not a copyright. TMs are protected as brand identifiers only. Just because someone gets a trademark application on NSFW doesn't mean no one on the internet can ever use it again. They just can't use it as the name of a website. Are you all going "OMG! Apple took the word apple and now we can't use it ever again!"?

trademark != patents != copyright. Without going into a long and overblown rant, they'd need to demonstrate a use in interstate commerce to even be able to file the application (or at least an intent to use in interstate commerce).
No, prior art does not apply in the TM case, but a prior use in commerce will prevent them from asserting that you infringe their mark for the territory you used it in.
That's all for now. There's way too many ways this is dumb and lame and just.... well, dumb again.

You know, before TLAs (three letter acronyms) were all the rage, I used BFD in an article I wrote about 37 years ago.
It was censored, until 80% of my high school class signed a petition indicating that it was ridiculous to censor that since it could mean so many things (every person signing the petition gave an alternative to the obvious, my favorite of which were big fat dicks and butt fucking dogs.

First, near as I can tell, reading the actual application, they haven't applied for a trademark for the acronym NSFW, but rather the literal phrase, "Not Safe For Work". That's my reading of it, at least. Note it's an application for a Trademark; not a patent, or a copyright.
Secondly, this is FARK. Is there even a remote possiblity that they're serious?
